UK criminal record checking system breaches European law

The Court of Appeal has found that the UK's Disclosure and Barring Service checks (formerly CRB checks) are incompatible with the European Convention of Human Rights (ECHR).

The court stated that the disclosure of all criminal convictions regardless of their relevance to the job in question, was incompatible with Article 8 of the ECHR, the right to a private life.

The UK Home Office is appealing the decision at the Supreme Court, England's highest court, therefore no changes to the DBS system will be made at present.

The DBS has emphasised that for those seeking criminal record checks in the meantime it will be "business as usual".
